The damages that you can recover in a property casualty first party claim depend on whether it’s strictly breach of contract or whether it’s also bad faith. In a breach of contract case, you can recover up to the value of that contract up to your policy limits. It’s basically you can recover the amount that the insurance company has promised you they will pay if you have a loss. If the insurance company has also committed bad faith, there are additional bad faith damages available above and beyond he coverage limits of the policy.
