What Should I Do If My Insurer Blames Me For The Property Damage?

Posted on Aug 29, 2025 at 4:14pm

TRANSCRIPT:

If your insurance company is blaming you for the property damage, that is a situation where you want to immediately contact an attorney. What they are likely claiming in that situation is that you have violated what’s called the intentional acts provision or that the intentional acts exclusion applies. And what that means is even if you have a covered loss, if you yourself caused that loss, you can’t recover. that there are rules to that as well. If the insurance company thinks that you were negligent, for example, because you left a candle burning, that’s different from an insurance company saying that you intentionally set fire to your house. So, it’s important to understand exactly what it is the insurance company thinks that you did and what provision or exclusion that they think that you violated. And the best way to figure that out is to hire an attorney as soon as possible.
