What is a property and casualty lawsuit?

“Property and casualty lawsuits are breach of contract cases. So your policy is in essence a contract. You make a promise to the insurance company that you are going to pay your premiums every single month, and in return that insurance company promises that if you have a loss and if that loss is covered, they will pay you for that loss. So, if you get into a situation where you have made a claim and you believe and there’s evidence to support that claim, but the insurance company denies it or partially denies it or delays the adjustment of that claim, then they have done what’s called breaching the contract. We would file a lawsuit to address that breach. If we also discover that they have committed the tor of bad faith, we would also include a bad faith count.”
