How Long Do I Have To File a Lawsuit After an Uber Accident in Kentucky?

The statute of limitations in Kentucky for personal injury claims is typically two years from the date of the accident or the last Personal Injury Protection (PIP) payment, whichever occurs later. This applies regardless of whether the injured person was the driver or a passenger in the Uber, another motorist, or a pedestrian. 

But there may be exceptions. For example, if a minor was involved in the incident, this may extend the timeline. Similarly, Uber collisions with a government vehicle may lead to shorter deadlines. It’s important to act promptly after a crash, as these legal time limits can approach quickly and may prevent you from recovering compensation if missed. Waiting too long to file can also lead to missing evidence and less time to negotiate with insurers.

Who Can Be Held Liable in a Kentucky Uber Accident?

Multiple parties may be at fault in a Kentucky Uber collision, depending on the circumstances of the incident. The Uber driver may be held responsible if they acted negligently and caused another person’s injuries, whether it was a passenger or someone outside of the car. Similarly, another motorist on the road can be held liable if they caused a collision with a Rideshare vehicle.

When the Uber Driver Is At-Fault

In cases involving an Uber driver’s negligence, insurance coverage will depend on the individual’s status. For instance, if their rideshare app was off at the time of the wreck, the driver’s personal insurance will cover the damages. If the app was on but no ride had been accepted, Uber’s contingent liability coverage may apply. This provides up to $50,000 in bodily injury coverage per person, $100,000 per accident, and $25,000 for property damage.

However, once the driver accepts a ride or has a passenger in the vehicle, Uber’s commercial insurance coverage becomes active. This includes up to $1 million in third-party liability coverage, along with uninsured and underinsured motorist (UM/UIM) coverage. For passenger injuries during this period, the $1 million liability policy typically applies.

When Another Driver Is At-Fault

If another motorist acted negligently and caused a crash involving an Uber vehicle, that driver may be held legally responsible. Injured parties—including Uber passengers, the Uber driver, or a pedestrian—can typically file a claim against the at-fault driver’s insurance.

If the at-fault driver is uninsured or lacks sufficient coverage, Uber’s uninsured/underinsured motorist (UM/UIM) coverage may apply—but only if the Uber app was active and a ride was in progress at the time of the incident.

The at-fault driver’s policy is the primary source of compensation. However, when that coverage is inadequate or fault is disputed, an injured passenger may be able to pursue claims through multiple insurance providers, including Uber’s commercial policy.

Pedestrian or Third-Party Claims

If an Uber driver hits a pedestrian or causes damage to a third party, the following coverage will apply:

  • Uber driver off the app: Personal insurance
  • App on, waiting for ride: Uber’s limited contingent policy
  • During a trip or en route: Uber’s $1 million policy

Pedestrians can also file a claim against other at-fault drivers who caused the crash involving the Uber vehicle.
