How Much Is My Personal Injury Case Worth?

When you’re talking about a personal injury case, the damages are broken down into medical bills, lost wages or future lost earning capacity, pain and suffering, and what’s called loss of consortium, which is basically a claim that belongs to a spouse or parents or children of somebody who’s hurt. So, what is your case worth? What you need to do is look at the medical bills that you’ve accumulated and the lost wages from any time that you spent off work at your doctor’s orders because you were put on restricted duty or taken off work entirely. Those are going to form the foundation of your claim. You can think of your pain and suffering value as sort of a part of the medical bills. The higher your medical bills go, the more likely it is that you’re going to get a high pain and suffering award. But lower medical bills mean it’s likely you’ll have a lower pain and suffering award. The most important thing to know about the value of a settlement in a case is you have an absolute right to transparency in where the settlement money goes. So you’re going to see a settlement breakdown at the end of every case that lists the gross amount of the settlement, anything that goes toward fees and expenses, anything that goes toward liens from say like a health insurance company, and then finally a net that goes to you.
