Can I File a Lawsuit if My Loved One Was Killed in a Motorcycle Crash?

If your loved one was killed in a collision, you have the right to file what’s called a wrongful death claim. A wrongful death claim is a little different from a typical injury claim because you have to set up an estate and make sure that you are the administrator or executor of that estate before you can actually file the claim or sign off on anything that would allow us to gather evidence for the claim. When you’ve got a wrongful death claim, you need to make sure you call an attorney immediately because we need to file your estate for you and make sure that you’re set as the administrator. In Kentucky, the statute of limitations on a wrongful death claim is one year from the date of death or one year from the date you were made administrator, not to exceed two years from the date of death. In Ohio, the statute of limitations on a wrongful death claim is two years from the date of death. If you’re the spouse of someone who’s passed away or the parent or child of someone who’s passed away, we’ll have what’s called a loss of consortium claim. The loss of consortium claim is often the most powerful claim and it’s helpful to have an attorney help you navigate how to tell that story.
