How to Prove an Injury Claim After a Car Accident

Another frequent denial is based on pre-existing injuries. So let’s say you’re in a fairly straightforward car wreck. The other person rear-ends you. We know who’s at fault, but you get a back injury, and you’d already had a minor back injury for which you were seeing a chiropractor. This back injury is worse, but maybe not all the way to being surgical. How do you decide how much of your damages are related to the prior back injury and how much are related to this wreck? The insurance company frequently won’t agree with you on that, and nobody can feel what you feel. So again, it’s often up to us, the attorneys, to go to the doctor, to go to witnesses, to go to members of your family, and get evidence that tends to prove that the majority of what you’re experiencing now is related to the wreck itself and not to what you had going on before.
