If you’re speaking with an insurance adjuster, the first thing to know is whether it’s your insurance company that you paid the premium for or the other person’s insurance company. If it’s your insurance company, you’ve got a duty to talk to them under your insurance contract. It’s okay to say that you want to schedule a time. It’s okay to say you want to have a lawyer present, and you probably should do those things, but you can’t turn them down or you won’t have coverage. If it’s the other side’s insurance company, you need to be very leery of talking to them without having an attorney present. They will try to trap you in questions. They are working for the other side in whatever collision you were in, and they are going to try to make you answer things in a way that take liability off of their insured and put it on you.
