Can I Still Recover Compensation if I Wasn’t Wearing a Bicycle Helmet?

Posted on Aug 21, 2025 at 4:22pm

TRANSCRIPT:

If you’re injured in a bicycle collision with a car and you’re not wearing a bicycle helmet, you absolutely have the right to file a claim and you can still recover damages. It’s possible that the jury may assess some of the fault for your injury against you if wearing a helmet would have stopped that injury from occurring, but that doesn’t mean you don’t recover, only that you might recover less.
