Kentucky has what’s called pure comparative fault. What that means is if you go to trial, a jury is going to assess the percentages of liability on each party. Was the other side 100% at fault and you were 0% at fault or is it something in the middle where both sides share some blame? In Kentucky, no matter what percentage is assessed, you are able to recover some money for your claim. But the lower percentage put on the other party, the less money you can recover.
