Ohio has something called modified comparative fault. And what that means is if you go to trial, a jury has to assess percentages of liability. Was the other side 100% at fault and you 0%, or is it split up in some way? In Ohio, if the other side is at least 51% at fault, you can recover money for your claim. But if both parties were 50% at fault, you don’t recover anything.
